These Terms of Service (“Terms”) govern your use of the LovelyTribute platform, which includes our mobile app and website. By accessing or using our platform, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing, browsing, or using the LovelyTribute platform, you agree to these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you are prohibited from using or accessing this Platform.

2. Use of the Platform

You must be at least 18 years old to use the LovelyTribute platform. By using the platform, you represent and warrant that all information you provide is accurate, current, and complete. You will safeguard your account credentials and accept responsibility for all activities that occur under your account.

3. Services Offered

LovelyTribute is a comprehensive online obituary and funeral service platform designed to assist families in honoring their loved ones. Whether you're creating meaningful obituaries, organizing memorial services, or booking funeral-related services such as hearse rentals, chair rentals, and more, LovelyTribute offers a seamless, user-friendly experience.

LovelyTribute provides tools to organize funerals and connect users with third-party vendors offering services such as funeral organization, hearse hiring, and equipment rentals. LovelyTribute does not directly provide these services but connects users with third-party vendors.

4. User Obligations

By using the platform, you agree to provide truthful and accurate information, respect the rights of others, and comply with applicable laws. You also agree to not engage in any fraudulent, abusive, or harmful behavior on the platform.

Prohibited Activities
In addition to other restrictions outlined in these Terms, you agree that you will not:

• Use the Services for any unlawful purpose, beyond their intended use, or in a manner prohibited by these Terms;
• Engage in actions that could interfere with, disrupt, or negatively impact other users’ experience, or harm, overload, or impair the functioning of the Services;
• Compromise the security of the Services in any way;
• Send unsolicited advertisements, spam, or unauthorized promotional materials;
• Use automated tools (such as bots, spiders, crawlers, or scrapers) not provided by us to access or extract data from the Services;
• Reverse engineer any part of the Services or attempt to uncover source code, or bypass restrictions designed to control access to certain areas or content;
• Use another user’s account without permission;
• Bypass content filters or attempt to access restricted areas or features of the Services without authorization;
• Imply any relationship with us, or claim endorsement for products or services, without explicit written consent;
• Engage in harassment, intimidation, predatory, or stalking behaviors;
• Impersonate another individual or entity, or misrepresent your association with any person or group;
• Violate others’ privacy, publicity, or data protection rights, such as taking photos of someone without their consent;
• Infringe upon any intellectual property rights, including patents, trademarks, copyrights, or trade secrets;
• Buy, sell, rent, or lease access to your account in exchange for compensation;
• Create or use third-party applications that interact with the Services or User Content without our prior approval;
• Use the Services for unauthorized or illegal purposes, or encourage or promote activities that violate these Terms.
• Additionally, you agree to comply with any third-party terms applicable to posting reviews, including those of Google Play Store.

5. Third-Party Services

LovelyTribute connects users to third-party vendors. We are not responsible for the actions or inactions of these vendors. You are encouraged to review each vendor's terms and conditions before proceeding with a transaction.

6. Payment and Fees

LovelyTribute is a comprehensive online obituary and funeral service platform designed to assist families in honoring their loved ones. Whether you're creating meaningful obituaries, organizing memorial services, or booking funeral-related services such as hearse rentals, chair rentals, and more, LovelyTribute offers a seamless, user-friendly experience.

Service Providers and Fee Structure LovelyTribute serves as a bridge between families and funeral service providers. The platform allows service providers to list their offerings and charge fees for their services. These services include, but are not limited to, funeral transport, chair rentals, catering, and event planning for memorials. While the platform makes it easy to connect with trusted providers, it does not directly handle or facilitate payments between users and these providers.

Some of the payments service providers use on the platform and in the mobile app includes but not limited to Mobile payments, digital wallets, Money transfer and money wire. These payment methods rely on third-party service providers. LovelyTribute and all its affiliates have no control over these mediums of payments.

Exercise Caution When Making Payments
As LovelyTribute is not directly involved in the payment process, we strongly advise users to exercise caution when making payments to service providers. Ensure that you communicate clearly with providers, verify their credentials, and agree on all terms before proceeding with any transaction. Where possible, opt for secure and traceable payment methods to avoid any issues related to service delivery or fraud.

By using LovelyTribute, families can focus on what truly matters—honoring the life and legacy of their loved ones—with peace of mind knowing they have access to trusted service providers and the tools they need to plan meaningful tributes.

7. User-Generated Content

By submitting content (e.g., funeral arrangements, tributes) on the platform, you grant LovelyTribute a non-exclusive, royalty-free, perpetual license to use, modify, and distribute that content. You are responsible for ensuring the content complies with applicable laws.

8. Intellectual Property

All content on the LovelyTribute platform, including text, images, logos, and software, is the property of LovelyTribute or our licensors. You are not permitted to reproduce or distribute any content without express permission.

9. Termination

LovelyTribute reserves the right to terminate or suspend your access to the platform without notice if you breach these Terms.

10. Limitation of Liability

To the fullest extent permitted by law, LovelyTribute shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform or third-party services.

11. International Users (Users outside the United States of America)

The LovelyTribute Mobile app and LovelyTribute website (the Services) are hosted in the United States. If you are a user accessing the Services from the European Union, Africa, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States, please be advised that through your continued use of the Services, which are governed by US law, you are transferring your personal information to the United States and you consent to that transfer.

12. Disclaimer of Warranties

The platform is provided "as is" and "as available." LovelyTribute makes no warranties regarding the availability or reliability of the platform.

13. Indemnification

You agree to indemnify and hold harmless LovelyTribute from any claims or liabilities arising from your use of the platform.

14. Changes to Terms

LovelyTribute reserves the right to modify these Terms at any time. Changes will be posted on the platform, and your continued use of the platform after modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the laws of United States of America. Any disputes arising under these Terms will be resolved in the courts of the laws of United States of America.
